Terms of Service

The Booking Advisor (“we”, “us”, “the Platform”) operates www.thebookingadvisor.com, a marketplace that lets hosts list experiences, guests book them, hotels receive direct bookings and recommend curated experiences, and affiliates earn commission by referring traffic.

By using the Platform — whether browsing, booking, listing, or referring — you accept these Terms. If you don’t accept them, please don’t use the Platform.

We may update these Terms from time to time. The “Last updated” date above tells you when. Continued use after an update means you accept the revised Terms.

You must be at least 18 years old and able to enter into a binding contract. By creating an account you confirm both.

Keep your password confidential. You’re responsible for everything that happens under your account. Tell us at once if you suspect unauthorised access.

We may suspend or terminate accounts that violate these Terms, the spirit of the Platform, or applicable law — including fraud, contact-information leakage, off-platform booking circumvention, or abusive behaviour.

When you book an experience, stay, or package on the Platform, you enter into a contract with the host, the hotel, or the booking partner — not with us. We facilitate the transaction and collect payment on their behalf.

Prices, availability, inclusions, cancellation policies, and meeting details are supplied by the host or booking partner. We take reasonable care to surface accurate information but do not guarantee it.

Cancellation policies are shown on each listing before you book. Refunds (where applicable) are processed to your original payment method, typically within 5–10 business days.

Hosts are independent service providers. You represent and warrant that:

• You have full right and authority to offer the experience you list;
• Your listing accurately describes the experience, including meeting point, duration, inclusions, and any requirements or restrictions;
• You will deliver the experience substantially as described, on time, and in compliance with all applicable laws, insurance requirements, and permits;
• You will not leak phone numbers, personal emails, social handles, or off-platform booking URLs into public listing fields. We auto-filter these and may suspend listings for repeated violations.

Commission. The Platform retains 25% of each confirmed booking (or 15% on the Pro tier, when available). You receive the balance. Payouts are made in INR to your registered UPI, bank account, or PayPal email, typically within 5 business days of a requested cash-out once your pending balance exceeds ₹500.

Off-platform circumvention. If you redirect or accept bookings outside the Platform from a guest introduced via the Platform, we may (a) withhold or forfeit your pending balance, (b) suspend or terminate your account, and (c) invoice you for the lost commission at 25% of the off-platform booking amount.

Hotels partner with the Platform to (a) receive direct bookings through their branded landing page, (b) earn a configurable share on guest-booked experiences, and (c) offer guests curated services through the Travel Desk.

Hotels set their own room rates and remain solely responsible for delivering the accommodation as advertised.

Affiliates earn 20% of the Platform’s commission on bookings attributed to their referral code for 60 days after the guest’s first click. Affiliates also earn 5% of the lifetime earnings of any affiliate they recruit.

Fraudulent traffic — including but not limited to self-referrals, incentivised clicks that don’t convert to genuine bookings, cookie-stuffing, or misrepresenting the Platform — will result in forfeiture of pending balances and termination.

Some pages on the Platform include links or search tools powered by third-party booking partners (e.g. Aviasales, Hotellook, KiwiTaxi, GetYourGuide, Viator, and others). When you book with them you enter a direct contract with that partner. Their terms, privacy policies, and customer-support processes apply.

We may earn a referral commission on those bookings at no additional cost to you. The price you see is the price on the partner site.

Payments on the Platform are processed by Razorpay (India) or a comparable licensed payment processor. We do not store your full card details. Payouts to hosts, hotels, and affiliates are made in INR unless otherwise agreed.

You agree not to: (a) use the Platform for any unlawful purpose; (b) upload content that is misleading, defamatory, infringing, obscene, or violates any third-party rights; (c) attempt to compromise the Platform’s security; (d) scrape, crawl, or programmatically extract data without our written consent; (e) impersonate another person.

The Platform’s name, logo, design, copy, and software are owned by us. Host content (photos, descriptions, videos) remains owned by the host, who grants us a worldwide, royalty-free licence to display it on the Platform and in reasonable marketing.

The Platform is provided “as is”. We disclaim all warranties to the fullest extent permitted by law. Our maximum aggregate liability to you for any claim arising from your use of the Platform is limited to the greater of (a) the commission we earned on bookings you made or hosted in the 12 months before the claim, or (b) ₹5,000.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. fraud, gross negligence, death or personal injury caused by our negligence).

These Terms are governed by the laws of India. Any dispute will be resolved in the courts of competent jurisdiction in India, without prejudice to any mandatory consumer rights you may have in your country of residence.
